Iowa Court of Appeals Affirms Win for Elverson Vasey Client
Elverson Vasey Partner, Josh Strief, successfully defended the City of Cresco before the Iowa Court of Appeals in a recent property dispute about an easement. In Haw v. City of Cresco, plaintiffs alleged a fence and gate constructed by the City unlawfully interfered with their easement rights. After trial, the district court ruled in favor of the City. Plaintiffs appealed, and after oral argument the Court of Appeals affirmed the dismissal, holding that the City’s actions were reasonable and did not violate the easement.
