Attorney Jon Vasey Obtains Summary Judgment for Dram Shop Client in Iowa District Court

The Iowa District Court for Polk County granted Attorney, Jon Vasey’s, Motion for Summary Judgment in full and dismissed all claims asserted against Mr. Vasey’s dram shop client. The Plaintiff argued Mr. Vasey’s client, who owned an establishment that served alcoholic beverages, was responsible for the intoxication of the alleged tortfeasor under the Iowa Dram Shop Act. Mr. Vasey successfully argued his client could not be held liable for damages because their was insufficient evidence to establish his client sold and served alcohol to the allegedly intoxicated driver or had reason to believe the driver was intoxicated. The Court agreed with Mr. Vasey that the Plaintiff did not provide sufficient evidence to prove his client was liable. The Court entered summary judgment for Mr. Vasey’s dram shop client and assessed all costs to the Plaintiff.
